Tiago Melo Alves was a guest on RTP's ‘Prova dos Factos’ programme, where he explained the reasons for the condemnation of the Portuguese state by the European Court of Human Rights (ECHR), saying that it could have been avoided if the mother and daughter involved in the case had been heard. At issue was an elderly woman's wish for her youngest daughter to be her guardian.
The Portuguese courts decided instead to put the eldest son in charge. After years of legal disputes, the Portuguese state was ordered to pay compensation.
‘It would have been enough for them to have listened to the mother and daughter (...), it would have been enough for them not to have ignored the documents, namely the powers of attorney,’ to avoid being condemned, commented Tiago Melo Alves to questions from the Prova dos Factos journalist.
‘We have cases that are transversal and that are constantly repeated.’ ‘Portugal is constantly condemned,’ namely “for violating due process, which has to do with the reasonable time a court must take to decide a person's case from start to finish,” he added.
