Melo Alves has been increasingly involved in international judicial co-operation cases.
Our experience includes intervention in extradition proceedings and European arrest warrants by a foreign/national authority, legal support for people called upon to collaborate with the criminal justice system of another state, people arrested abroad, the transfer of convicts, victims of criminal activity with cross-border links, the collection or sending of evidence to other states, among others.
If the majority of citizens are unfamiliar with legal rules and procedures, they are completely unfamiliar with cross-border cases. There are countless questions that arise for those involved in transnational proceedings: How long can I be detained? Am I obliged to be imprisoned in a foreign country? Can I contact my family? What are my rights? Can I enforce the rights granted to me by my country's legislation in a foreign country? How can I defend myself if I have been the victim of a cross-border crime?
There is no doubt that the procedural fragility of these players is extremely high, given their total lack of knowledge of these matters and of the language in which the procedural acts are carried out, and (not infrequently) their incarceration in a foreign prison.
This weakness can only be overcome by using a team of experienced lawyers who have a network of contacts of lawyers qualified to act in a foreign state. Our membership of associations such as the European Criminal Bar Association strengthens precisely this link to a network of international lawyers with whom we work closely to obtain favourable results for our clients.
